If you are just now going into a custody case, or you know that you are about to, you will want to take some time to think about all of the things that you will want your custody attorney to address for you. This would be either with the other parent, their attorney, or with the judge directly. The more you prepare for your custody case, the more likely it is that you will not walk away from this situation without feeling properly represented and heard by the courts.
Rights To Be Included On Big Decision Making
If your children will be living with the other parent most of the time, you may still want to make sure that you are consulted when it comes to the big decisions that are made for your children. Such decisions may include things like where they will go to school, who their doctor's will be, what religion they will practice, and any major medical treatments or surgeries.
What The Visitation Schedule Will Look Like
Whether you will have equal time as parents, or one will have primary custody while the other has weekend visits, you want to make sure that you are getting all of the details worked out now, as this will help reduce the chances of misunderstandings in the future. Also, remember that visitations for holidays may be figured separately from the regular schedule. Some parents will split the days of the holidays in half, while others will alternate years. Try to figure out what might work the best for everyone involved and have that included in the legal documents.
Who Pays For What
If one parent is going to have the children in their custody more than the other parent, then that parent may be entitled to child support. It would be a good idea to see if the child support amount could be agreed upon before a judge has to step in and make the decision for everyone.
Make sure that you are scheduling a time to speak with your attorney about the things mentioned here. You will want to write down all of your questions and concerns, even ones that you think of between now and your appointment with the attorney. The more you stay organized, the easier it will be to make sure that you are not missing out on any crucial points. You do not want to think that you are finally done with your custody case, only to later discover that there are some important issues that you forgot to have addressed and included in the custody agreement.
